1. Be brief! Make your point as concisely as possible. If you can clearly argue your point in several sentences, do so. Judges will thank you.

2. Recite essential facts only. Often, motions or briefs unnecessarily recite the entire history of the dispute and litigation. Identify the precise issue being argued. For example, is it a discovery issue? If so, then only facts regarding the discovery requests, responses, and omissions need be discussed. Requiring judges to read immaterial facts wastes judicial time. Include in your brief or motion only the facts essential to the pending issue.

3. Shorten your sentences. In addition to stating only the essential facts, simplify and shorten your sentences. Consider the following example.

“On or about January 14, 2009, the Plaintiff, Jane Doe, and the Defendant, John Smith, entered into a contract for the sale and purchase of improved real property located in Jefferson County, Florida.”

“On January 14, 2009, Doe agreed to purchase Smith’s home.”

The detail in the first example might be necessary to establish venue or jurisdiction in an original pleading. However, for most other purposes, the second sentence more concisely and clearly states the essential information. Moreover, the phrase “on or about” is rarely appropriate. When you know the exact date of an event (and you almost always will), then use the exact date.

4. Use headings and sub-headings to organize your argument. When your brief addresses multiple issues or multiple arguments on a single issue, use headings and sub-headings to organize your material. The first sentence is shorter but more aggressive. When opposing a sympathetic litigant– here, a catastrophically injured plaintiff– the tone of the first sentence may offend your reader.
